Terms of Service

These terms govern your use of forgewellcookware.com and every order you place with us. By using the site or placing an order, you agree to them.

1. Who we are

This website is operated by Forgewell Cookware (“Forgewell”, “we”, “us”, “our”).

Throughout these terms, “you” means the visitor or customer using this site.

2. Acceptance of these terms

By visiting our site or purchasing from us, you engage in our service and agree to be bound by these Terms of Service, including any additional terms and policies referenced here or available by hyperlink, in particular our Shipping Policy, Return Policy, Privacy Policy and Cookie Policy.

If you do not agree to all of these terms, you may not access the website or use any of our services.

3. Eligibility

You must be at least 18 years old, or the age of majority in your country of residence, to place an order. By ordering you confirm that you meet this requirement and that the information you provide is accurate and complete.

You may not use our products or website for any unlawful purpose, or in any way that could damage, disable or impair the site or interfere with another party’s use of it.

4. Products and descriptions

We take great care to describe and photograph our products accurately. Even so, we cannot guarantee that your screen displays colours and finishes exactly as they appear in reality. Hand hammered titanium in particular varies slightly from piece to piece, which is a characteristic of the process rather than a defect.

Products are offered subject to availability. We reserve the right to limit quantities, to discontinue any product, and to refuse or cancel any order at our discretion. Where we cancel an order you have already paid for, you receive a full refund.

All product descriptions, specifications and prices are subject to change without notice.

5. Pricing and payment

Prices are shown in the currency selected at checkout. The price you see is the price you pay: no sales tax or VAT is added at checkout.

Your order ships from the Netherlands. Depending on your country and the value of your order, local import duties, taxes or customs handling fees may be charged on delivery. These are set by your own authorities, are outside our control, and are the responsibility of the recipient. See our Shipping Policy for detail.

We accept the payment methods displayed at checkout. Payment is taken at the moment the order is placed. Your order is confirmed only once payment has cleared and you have received an order confirmation email.

Shipping is free on all orders. Any optional express service is priced separately and shown before payment.

Should an obvious pricing error occur, for example a price that is clearly wrong by an order of magnitude, we reserve the right to cancel the affected orders and issue a full refund, even after confirmation.

6. Orders, shipping and delivery

Processing takes 1 to 3 business days and transit 5 to 12 business days, for a total of 6 to 15 business days. These are estimates rather than guarantees. Full details are set out in our Shipping Policy, which forms part of these terms.

Please check your delivery address carefully. Address changes are possible only before dispatch.

7. Returns, cancellation and refunds

Consumers in the United Kingdom and the European Union have a statutory right to withdraw from a distance purchase within 14 days of receiving the goods. On top of this, we offer a voluntary 30 day return window.

The conditions, procedure and refund timelines are set out in full in our Return Policy, which forms part of these terms. Nothing in these terms limits your statutory consumer rights.

8. Warranty

Forgewell products carry a 25 year warranty against defects in materials and workmanship from the date of delivery. Where such a defect appears, we will repair or replace the product at our discretion and at no cost to you.

The warranty does not cover normal wear and tear, surface discolouration, damage caused by misuse, overheating, thermal shock, abrasive or caustic cleaning products, commercial or industrial use, accidental damage, or any modification of the product. The warranty is offered to the original purchaser and is not transferable. It applies in addition to, and never in place of, your statutory rights under applicable consumer law.

9. Safe use of our products

Cookware becomes extremely hot. Always use appropriate protection when handling a pan that has been on the hob or in the oven, keep hot cookware out of reach of children, and never leave an empty pan on a live heat source. Our products are oven safe up to 260 °C (500 °F). Exceeding that may damage the product and voids the warranty. Please follow the care instructions in our Guides.

10. Accuracy of information on this site

We are not responsible if information made available on this site is not accurate, complete or current. The material here is provided for general information only and should not be relied upon as the sole basis for a decision. Any reliance on the material is at your own risk. We may change the content of this site at any time, but we are under no obligation to update it.

11. Accounts and personal information

If you create an account, you are responsible for keeping your password confidential and for all activity that occurs under it. Notify us immediately of any unauthorised use.

Your submission of personal information through the store is governed by our Privacy Policy.

12. Comments, feedback and submissions

If you send us creative ideas, suggestions, reviews or other material, whether at our request or unsolicited, we may use, edit, copy, publish and distribute that material without restriction or obligation to compensate you. You agree that your submissions will not violate the rights of any third party and will not contain unlawful, abusive or defamatory content.

13. Intellectual property

All content on this site, including text, photography, graphics, logos, product designs, page layouts and software, is the property of Forgewell Cookware or its licensors and is protected by copyright, trademark and other intellectual property laws. You may not reproduce, distribute, modify or create derivative works from any part of it without our prior written permission.

14. Third party links and services

This site may contain links to third party websites and uses third party services such as payment processors, analytics providers and shipping carriers. We are not responsible for the content, accuracy or practices of third parties, and their inclusion does not imply endorsement. Please review their terms and privacy policies before using them.

15. Limitation of liability

To the fullest extent permitted by applicable law, Forgewell Cookware is not liable for any indirect, incidental, special or consequential damages arising out of your use of this site or of any product purchased through it.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded. Where liability cannot be excluded but can be limited, it is limited to the amount you paid for the product concerned.

Consumers retain all rights granted by mandatory national consumer protection law, which these terms do not affect.

16. Indemnity

You agree to indemnify and hold harmless Forgewell Cookware and its officers, employees and suppliers from any claim or demand, including reasonable legal fees, made by a third party as a result of your breach of these terms or of any law or the rights of a third party.

17. Termination

These terms are effective unless and until terminated by either you or us. You may terminate them at any time by ceasing to use the site. We may terminate them at any time without notice if you fail to comply with any of their provisions, and you will remain liable for all amounts due up to that date.

18. Severability

If any provision of these terms is found to be unlawful, void or unenforceable, that provision is severable and does not affect the validity and enforceability of the remaining provisions.

19. Changes to these terms

We may update these Terms of Service at any time by posting a revised version on this page. The version in force at the moment you place an order is the version that applies to that order. It is your responsibility to check this page periodically.

20. Governing law and disputes

These Terms of Service are governed by the laws of the Netherlands. Disputes will be submitted to the competent court in Rotterdam, The Netherlands, unless mandatory consumer law entitles you to bring proceedings in the courts of your own country of residence.
